The “Guaranteed Visa” trap: When the guise of an expert pushes the FDI board of directors into imprisonment
Vietnam always opens its doors to welcome experts and highly technical foreign workers to work at FDI enterprises. However, legal regulations on applying for a Work Permit and Temporary Residence Card (TRC) are becoming increasingly strict, especially the mandatory requirement for a university degree in the correct major and a Certificate of Experience from 3-5 years abroad.
Faced with the pressure to bring experts into the factory to work immediately, many Human Resources (HR) Directors have resorted to a deadly “shortcut”: Hiring “guaranteed pass” Visa/Work Permit consulting services online.
These services promise to process any flawed application for a “diplomatic” fee. FDI Directors close their eyes and sign the sponsorship papers, assuming: “This is just an administrative procedure; I hired a full-package service, so they must be responsible”. They are unaware that those “magically” fabricated papers are turning them into transnational criminals under the lens of the security investigation agency.
1. Legal fatal pitfall: Not just “Administrative Fines” or “Deportation”
Many Expats mistakenly believe that Visa violations will, at worst, only result in a fine of a few tens of millions of VND and deportation back to their home country. However, when the Security Investigation Agency dismantles the rings forging residence applications, the nature of the case immediately shifts to criminal with devastating sanctions:
1.1. First, the crime of organizing or brokering illegal exit, entry, or stay in Vietnam (Article 348 of the 2015 Penal Code)
If an FDI company signs sponsorship papers for a foreigner to enter and stay in Vietnam, but in reality, this person does not work for the company (lending legal entity status), or knows clearly that this person’s dossier is ineligible but still colludes with the service provider to circumvent the law.
- The Legal Representative (CEO) signing the sponsorship application and the HR Director could face a sentence ranging from 01 to 15 years in prison.
1.2. Second, the crime of forging seals and documents of agencies and organizations (Article 341 of the 2015 Penal Code)
To legitimize the application, service providers often forge foreign university degrees, forge certificates of experience, and even forge consular legalization stamps. Your use of this forged dossier to submit to the Department of Labor, Invalids and Social Affairs constitutes a crime carrying a sentence of up to 07 years in prison.
2. 3 “Trapping” scenarios putting Expats and HR behind bars
From our experience handling legal crises regarding foreign labor, Apluslaw points out the 3 most common scenarios:
2.1. Scenario 1: “Fake Degrees” and HR’s naivety
The parent company dispatches a technical engineer to Vietnam, but this person does not have a University degree. The “guaranteed pass” service secretly forged an Engineering degree from a university in Europe and affixed a fake consular legalization stamp. HR innocently presented it to the CEO to sign and seal across the adjoining edges of the pages to submit the application. When the Department of Foreign Affairs scanned the barcode and discovered the fake stamp, the police immediately stepped in. The CEO and HR were prosecuted for the act of using forged documents.
2.2. Scenario 2: Ghost sponsorship
Because the FDI company is not yet eligible to sponsor (has no branch operation license, or has run out of foreign labor quotas), the service provider used a “ghost” company they set up themselves to stand in as the sponsor for your Expat’s Visa and Work Permit. When the police conduct an administrative check at the residence and discover the Expat does not work for the sponsoring company, the entire ring will be arrested for the crime of organizing illegal stays in Vietnam.
2.3. Scenario 3: The “Virtual Investor” guise
To bypass Work Permit procedures, many Expats spend tens of millions of VND to buy a 1% share of a micro-company in Vietnam to apply for a Temporary Residence Card (DT3, DT4) under the title of “Investor”. Currently, the Immigration Department is extremely strictly reviewing actual capital contribution cash flows. Establishing front companies to buy and sell Visas is being heavily dismantled nationwide.
3. The consequences: A global “Career Cutoff”
A criminal conviction regarding immigration does not just stop at Vietnam’s borders:
3.1. Arrest warrants and exit bans
As soon as the ring is discovered, the Expat’s passport will be revoked, and they will be banned from exiting the country to serve the investigation. The HR Director and CEO who signed the sponsorship papers will be continuously summoned for questioning.
3.2. Deportation and “Blacklisting”
Foreign experts will be deported immediately and permanently banned from entering Vietnam. This information will be shared on the international immigration system, making it nearly impossible for them to apply for a Work Visa in any other country (USA, Europe, Singapore…).
3.3. Suspension of FDI enterprise operations
The company will be put on a special watch list by the management agency, stripped of the right to sponsor foreign labor for many years, causing the operation and technology transfer from the parent company to be completely paralyzed.
4. Building an “Immigration Compliance Shield” with Apluslaw
Recruiting foreign experts is a vital requirement for FDI enterprises, but it cannot be traded for the freedom of the Board of Directors. Apluslaw recommends applying the following strict compliance principles:
4.1. Due diligence on service partners and original dossiers
Immediately stop using “floating Visa services”. All diplomas and certificates of the expert must be verified for authenticity from the host country before submission in Vietnam. Apluslaw’s Lawyers will directly review the dossiers, eliminating 100% of the risk of forged documents.
4.2. Restructuring titles and licensing conditions
If the expert lacks degrees, Apluslaw Lawyers will advise on appropriate title conversions (e.g., changing from “Expert” to “Technical Worker” or “Executive Director”) to optimize the application according to the law without having to falsify documents.
4.3. Direct legal representation
Apluslaw will represent the enterprise to work directly with the Department of Labor, Invalids and Social Affairs, the Immigration Department, and transparently explain all issues regarding the necessity of using the labor, ensuring your Expat possesses the most legal, safe, and “clean” Temporary Residence Cards.
A legal Work Permit is a shield protecting the Expat’s career, but a “magically” fabricated dossier is a suspended sentence hanging over the heads of the entire FDI management apparatus. In the context of the state strongly purifying immigration activities, transparency is the only viable choice for survival.
